MACHINERY - 2006/142/EC Directive

Member States shall take all appropriate measures to ensure that machinery or safety components may be placed on the market and/or put into service only if it does not endanger the health and safety of persons and, where appropriate, domestic animals or property, when properly installed and maintained and used for its intended purpose.

Machinery and safety components shall satisfy the essential health and safety requirements set out in Annex I of the directive.

The manufacturer or his authorized representative established in the Community shall, in order to certify the conformity of the machinery and safety components with the provisions of this Directive, draw up, for each machine or for each safety component, a declaration of conformity, and shall, only for the machines, apply the CE marking.

Before marketing a machine, the manufacturer or his authorized representative established in the Community shall:

1) Where the machinery is not referred to in Annex IV of the directive, compile the technical file according to the instructions in Annex VII part A and apply the procedure for assessment of conformity with internal checks on the manufacture as provided for in Annex VIII.

2) Where the machinery is referred to in Annex IV of the directive and manufactured in accordance with the harmonised standards, compile the technical file according to the instructions in Annex VII, part A and apply one of the following procedures:

2a) procedure for assessment of conformity with internal checks on the manufacture provided for in Annex VIII.

2b) EC-Type Examination procedure and internal checks on the manufacture provided for in Annex IX.

2c) Full Quality Assurance procedure provided for in Annex X.

The procedures set out in Annexes IX and X specified in points "2b" and "2c" are carried out by Bodies and Notified to the European Community considered to be in possession of the minimum requirements set out in the directive.

3) The directive 2006/42/EC also introduces the concept of "Partly completed machinery" for which the manufacturer or his authorized representative established in the European Community shall prepare the relevant technical documentation as set out in Annex VII, part B, the assembly instructions as set out in Annex VI and draw up the Declaration of Incorporation as set out in Annex II, part 1, section B.
